(THUNDER BAY, ON) – MAN SENTENCED TO 4 MONTHS JAIL FOR ASSAULT ON WOMAN.
Appearing handcuffed in Plea Courtroom 102 before Her Honour Justice Chantal Brochu on Friday February 1,2019 is 33 year old KYLE MARCUS WADE LEWIS aka MACAULAY.
He’s wearing a gray and dark horizontal striped shirt with blue jeans that are too large and hanging low on his ass. He’s a smaller than average man with receding hairline.
Provincial Crown Attorney Gordon Fillmore is here along with defence lawyer Kate Brindley. They have a joint submission for Her Honour to consider on a charge of assault and breach of probation.
THE NAME CHANGE
First order of business is the defendant’s name. All court documents and computer records state his surname is MACAULAY.
Brindley tells the court that her client’s legal surname is LEWIS. He used to go by MACAULAY but is now LEWIS (his mother’s maiden name) Documents will be amended to reflect the change.
ADMITTED FACTS AND GUILTY PLEAS.
The court hears that on January 5,2019 that TBPS were called by a neighbour to an apartment on Moodie Street about a woman being assaulted. Police arrived to find a fearful woman hiding in closet. The neighbour had witnessed the woman being struck with a fist by LEWIS. He’d “flipped out” and grabbed the woman by the neck to throw her. He had also damaged a dresser, computer desk and ashtray.
LEWIS had escaped out a window when TBPS arrived. However, the Officers were quick to search the area and apprehended LEWIS before he left the building property.
LEWIS admits he was intoxicated by drugs and has no memory of the occurrence. He accepts the facts.
LEWIS is asked by Her Honour if he has anything to say.
“I SHOULD BE LEARNING MY LESSON BY NOW AND MOVING FORWARD. I APPRECIATE THE COURT’S TIME. I JUST WANT TO DO MY TIME” he responds.
CRIMINAL RECORD AND SENTENCING
The joint submission is 4 months jail along with submitting his DNA and a 5 year weapon prohibition.
LEWIS has a criminal record with numerous convictions. He was convicted of assault on the same woman on November 13,2018 for which he received probation. It’s an aggravating factor but Her Honour Brochu accepts the joint submission.
He’s served 28 real days in jail which is enhanced to 42 days due to conditions at the Thunder Bay Jail. He has another 78 days of his sentence to serve. But with statutory release will be out in less than 2 months.
LEWIS is led out of courtroom by TBPS Special Constables to go serve his sentence.
