WOMAN PLEADS GUILTY TO DESTROYING SCREEN DOOR AS WELL AS THEFTS FROM LOCAL BUSINESSES.
Appearing this morning, Friday January 4,2019 in Courtroom 102 before His Honour Justice Dino DiGiuseppe is 45 year old SHERRY MAWAKEESIC.
MAWAKEESIC is wearing a new black leather jacket, blue jeans and stylish black suede knee high boots.
She’s of average height and weight.
Crown Attorney Gordon Fillmore is present along with Defence lawyer Brandon Desmoulin.
PLEADING GUILTY WITH ADMITTED FACTS.
On April 19,2018 at 1am , Thunder Bay Police were phoned by a homeowner on West Frederica. They reported someone at their patio door who just showed up and ripped off the sliding screen door. Police show up and MAWAKEESIC is present with the broken door. Damage is estimated at 300$. The homeowner has no idea who MAWAKEESIC is. She is intoxicated. She is arrested and charged with mischief.
Later that same day, April 19,2018 at 8:15pm at the LCBO on Fort William Road, MAWAKEESIC enters the store and proceeds to the vodka section to grab a 750ml bottle of vodka valued at $26.75. She attempts to leave the store with it. A Loss Prevention Officer intervenes and tries to stop her. A struggle ensues and the bottle is destroyed. MAWAKEESIC is arrested, charged, and released again.
On August 15, 2018 at 7pm, MAWAKEESIC is in the Walmart on Arthur Street with another male. She’s observed placing 3 cans of soup in the male’s backpack, along with some clothing. She then proceeds to footwear section and puts on new footwear, then they attempt to leave the store without paying the $62.20 for the stolen items. They are confronted by a security officer and the male flees the scene. Police are called and MAWAKEESIC is arrested, charged and released again.
GLADUE FACTORS AND SENTENCING
MAWAKEESIC is originally from the Deer Lake Indian Reserve. She was raised in an alcohol filled community and abused as a child. She started drinking alcohol at 10 years old. Her criminal record starts in Sandy Lake in 1999 and her most recent criminal convictions are from Winnipeg in 2016.
She has her own apartment and went for Dilico alcohol treatment in 2017 but is unable to stop drinking. She’s unable to afford to repay any restitution to the homeowner or businesses.
The joint submission is for a suspended sentence with 12 months probation and community service.
Justice DiGiuseppe accepts the joint submission. MAWAKEESIC is ordered to attend counselling as required and perform 60 hours of community service.
