Assault and a couple mischief charges, bail granted


(THUNDER BAY, ON) – It’s Sunday today, and that means another session of W.A.S.H. (weekend and statutory holiday) court. The regions bail matters all get forwarded to Thunder Bay as all the other courthouses are stood down for the weekend.

First up on today’s docket is a 38-year-old Richard Nicolas Surdyka who is facing multiple charges from an incident over a month ago. Her Worship, Justice of the Peace Jennifer Neill was presiding along with Crown Attorney A. Mason and a duty counsel representative. He appeared by video while in police custody at the Thunder Bay Police Service station located at 1200 Balmoral.

Surdyka is facing the following criminal charges:

  • Assault
  • Mischief causing damage under $5000 x2

The Criminal Code of Canada describes assault as Every one who commits an assault is guilty of an indictable offence and is liable to imprisonment for a term not exceeding five years; or an offence punishable on summary conviction.

Mischief causing damage under $5000 is described by the Criminal Code of Canada as Every one commits mischief who wilfully destroys or damages property; renders property dangerous, useless, inoperative or ineffective; obstructs, interrupts or interferes with the lawful use, enjoyment or operation of property; or  obstructs, interrupts or interferes with any person in the lawful use, enjoyment or operation of property.

He is granted bail under the following conditions:

  • Reside at a residence on Primrose Street
  • No contact with one person
  • Not to be within 100 meters of anywhere that same person is expected to be
  • Not attend an address on Pearl Street
  • Not to buy or possess alcohol or other intoxicating substances
  • Not to possess any weapons as described by the Criminal Code of Canada

Surdyka has a future court date of January 11th, 2019 where the process of answering to the charges will begin. He is escorted back to his jail cell at the police station where he will wait for the bail-related paperwork to be completed and sent over from the courthouse before he can be released.

    This is a fine example of how opioid/alcohol addiction affects all races and cause people to do stupid things. He’s not native he’s white.
    He lives here in Thunder Bay. I expect a comment on this from Steve. But we probably won’t cause he is so focused and outraged with Native issues and how he takes native issues so personally and how it affects him. Btw. Cactuses are beautiful. Touch them the wrong way and you will be pricked.

    3. Loops – The last thing you’re going to do instigate me to play into your race baiting. My previous comments only suggested the incidents with Natives far outweighed those with the whites. That’s a fact. However, that really has nothing to do with what I’m trying (again) to convey to you.
      How many people do you hear calling the Police Racists because they arrested a white guy? None.
      How many people are calling on Fiddler to do something because a white guy was arrested? None.
      How many white guys are protesting because they keep getting arrested? None.
      How many white guys are blaming the generation 200 years ago for their actions? None
      How many white guys are in agreement with the Police they took the white guy off the street? Everyone. Is that clearer for you? Accountability. You should look that word up in the dictionary. It’s under the “A”s.

    4. White guys in jail are always saying they are innocent. Why do they appeal their judgments. And who pays for the court processes. Your tax dollars bubba. That’s why you work so hard to pay the tax man.

    1. No comment Steve? But if it was a Native man you would give him a hug and forgive him? I know you were being sarcastic in the other comments it was very clear. Clear to me you fear Natives. Also, you want to get personal think about your relationships with the native women (3) and why it didn’t work out for you.
