Appearing handcuffed in Courtroom 205 this morning is 26 year old ADAM CAPAY. He’s wearing a black hoodie and has a fresh Mohawk style haircut.

SUPERIOR COURT JUSTICE MARC FREGEAU HAS PREPARED A LENGTHY DECISION.

Crown Attorney Trevor Jukes is present along with CAPAY’S lawyers Karen Symes and Adriel Weaver from Southern Ontario.

CAPAY WANTS HIS FIRST DEGREE MURDER CHARGE TO BE STAYED BECAUSE HE FEELS HIS CHARTER RIGHTS WERE VIOLATED

Testimony was given from May through October 2018 from numerous witnesses.

In the early hours of June 3, 2012, CAPAY allegedly took a pencil, went crawling across the floor in the dark stabbed the neck of Sherman Quisses, a 35-year-old inmate, in the dorm-style room of the Thunder Bay Correctional Centre. Capay used a pencil to puncture Quisses’s carotid artery. Quisses, a father of one from a northern Ontario reserve, died the next day. Capay was charged with first-degree murder, and moved to the Thunder Bay Jail. CAPAY would spend the next 4 1/2 years in segregation as he had violent thoughts to harm or kill others including inmates and staff.
JUSTICE FREGEAU RULES THAT THE CHARGE WILL BE STAYED.

FAMILY MEMBERS OF QUISSES ARE NOT IMPRESSED. ONE MEMBER SCREAMS “FUCK” AS HE LEAVES THE COURTROOM.
