IMPAIRED, DEATH THREAT TO POLICE, ASSAULT POLICE, PISS ON THE FLOOR

(LAKE HELEN FIRST NATION, ON) – Appearing in a Thunder Bay bail court this morning via telephone from the Ontario Provincial Police detachment in Nipigon is 25-year-old Mikel Anthony Potan.

Her Worship, Justice of the Peace Denette Maslach is presiding, along with Crown Attorney Derrick Silvestro and duty counsel lawyer Stella.

Potan has found himself in some hot water, and is looking to get released from jail. Below are his charges stemming from a November 16th incident:

  • Impaired operation of a motor vehicle
  • Resist police by clenching fists and walking away from police
  • Utter death threat to police
  • Assault police
  • Assault police
  • Refuse to comply with a demand for a breath sample
  • Mischief under $5000 (urinating on the jail cell floor then shoving a prisoner blanket in the toilet)
  • Utter threat to cause bodily harm to police

The Crown states this is a Crown onus situation but he has some concerns regarding Potan’s release on the secondary grounds. Secondary ground concerns means the Crown believes there is a substantial likelihood for the accused to either re-offend, become a public safety concern, or interfere with the administration of justice.

Potan is releasable under some sort of supervision, the Crown tells the courts, but absent of any supervision, he intends to show cause as to why the accused should be detained.

Duty counsel states that his parents would supervise him, but they are currently out of town. The accused’s grandfather is another option yet no one has shown up in court or at the OPP detachment in Nipigon.

Potan says “I’m not a threat to anyone”

Duty counsel requests a remand until Monday so that a possible supervision plan can be crafted and confirmed.

The Justice of the Peace orders Potan remanded into custody to await his Monday court date, where he will have another swing at getting released. If someone shows up to offer supervision of Potan on release, he will most likely get out of jail.

Potan is going to be transported to the Thunder Bay District Jail, where he will wait until his Monday rendevous with courtroom 104.

  1. Another drunk driver. Yes he’s a threat to everyone on the road. Bail conditions should also include no alcohol.
