FORTY-ONE DAYS……That’s how long Adam Mark Capay was able to avoid a courtroom.
A 26 year old ADAM MARK CAPAY appeared by telephone in W.A.S.H. (Weekend And Statutory Holiday) Court today, Saturday March 9, 2019 from the Sioux Lookout OPP Station.
Her Worship, Justice of the Peace Denette Maslach is presiding. Provincial Crown Sarah Munsch is here along with Duty Counsel Joy Wakefield.
Duty Counsel Wakefield seems very inclined to try keep this a low information proceeding. She requests that the court waive reading of the charges. CAPAY also requests the same. No allegations are read.
Duty Counsel Wakefield requests a Section 517 publication ban on all evidence and testimony, along with reasons given.
Capay’s lawyer is Adriel Weaver from Southern Ontario.
Crown Attorney Munsch is not consenting to the release of CAPAY. He will spend the weekend in jail and appear in Sioux Lookout Bail Court on Monday March 11,2019 in person at 10:30am.
SEXUAL ASSAULT WITH A WEAPON AND MISCHIEF
Inside Edition sources indicate that ADAM MARK CAPAY was arrested by Sioux Lookout OPP last evening and charged with 2 criminal offences.
Section 272 (1) Every person commits an offence who, in committing a sexual assault, (a) carries, uses or threatens to use a weapon or an imitation of a weapon;
Section 430 (4) Every one who commits mischief in relation to property, other than property described in subsection (3), (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding two years; or. (b) is guilty of an offence punishable on summary conviction.
Sources further indicate that it is alleged ADAM MARK CAPAY raped a young aboriginal woman (18-23 years old) with threat of a weapon and damaged her property.
No local taxpayer subsidized media is reporting this alleged rape with a weapon and mischief.
ADAM CAPAY IS BACK IN THE FAMILIAR SURROUNDINGS OF A JAIL CELL.

FIRST DEGREE MURDER CHARGE STAYED AGAINST ADAM CAPAY
HE WILL NOT FACE TRIAL FOR FIRST DEGREE MURDER
Appearing handcuffed in Courtroom 205 this morning is 26 year old ADAM CAPAY. He’s wearing a black hoodie and has a fresh Mohawk style haircut.

SUPERIOR COURT JUSTICE MARC FREGEAU HAS PREPARED A LENGTHY DECISION.
Crown Attorney Trevor Jukes is present along with CAPAY’S lawyers Karen Symes and Adriel Weaver from Southern Ontario.
CAPAY WANTS HIS FIRST DEGREE MURDER CHARGE TO BE STAYED BECAUSE HE FEELS HIS CHARTER RIGHTS WERE VIOLATED
Testimony was given from May through October 2018 from numerous witnesses.
In the early hours of June 3, 2012, CAPAY allegedly took a pencil, went crawling across the floor in the dark stabbed the neck of Sherman Quisses, a 35-year-old inmate, in the dorm-style room of the Thunder Bay Correctional Centre. Capay used a pencil to puncture Quisses’s carotid artery. Quisses, a father of one from a northern Ontario reserve, died the next day.
Capay was charged with first-degree murder, and moved to the Thunder Bay Jail. CAPAY would spend the next 4 1/2 years in segregation as he had violent thoughts to harm or kill others including inmates and staff.
