(THUNDER BAY, ON) – Yesterday around 11:30 police initiated a traffic stop.
During the course of the police interaction with the driver, they suspected the driver to be impaired by alcohol. An investigation was conducted and as a result of that investigation, 33-year-old Boiyce Niemi was arrested, charged, and held in police custody pending a court appearance. The vehicle he was driving was towed away from the scene.
Niemi was held in police custody at the Thunder Bay Police Service (TBPS) station located at 1200 Balmoral Street. He appeared in court this morning via video link from the Balmoral Street facility. Justice of the Peace Zelda Kitchekeesic was presiding along with a Crown Attorney who I do not know her name and the outstanding criminal defence lawyer Aranka Golphy who was working the duty counsel table this morning.
This isn’t Niemi’s first impaired driving charge, he’s currently going through court for driving while impaired by drugs. Allegations are that he was high and driving shortly after midnight in November. Niemi was released from custody on that charge on November 19th, 2019. He’s now facing an impaired driving charge but this time alcohol was the factor.
Niemi is granted release from custody today under the following undertaking bail plan with no surety.
- Curfew 10:00 pm to 6:00 am.
- Not outside residence with alcohol in his body.
- Not to attend any establishments where the primary purpose of which is the distribution of alcohol.
- Not be behind the wheel of any conveyance.
He is scheduled to appear back in a Thunder Bay Courthouse courtroom on December 20th, 2019 to continue answering to the charges.
