SENTENCED TO 12.5 YEARS IN FEDERAL PRISON.

A JOINT SUBMISSION OF 11-14 YEARS IS MADE BY THE CROWN AND DEFENCE.
JOSEPH HARRY PRUYS SR. 63, was stabbed 14 times by an alcohol and cocaine enraged CASMEY, who was on bail at the time for other crimes including a high speed police chase through a residential neighborhood and ramming a police car.
JUSTICE OF THE PEACE DENETTE MASLACH RELEASED HIM ON $5000 NO DEPOSIT BAIL LESS THAN 2 WEEKS PREVIOUS TO THIS VIOLENT ACT DESPITE HIS HISTORY OF CRIME AND BREACHES.
Appearing before Her Honour, Senior Regional Superior Court Justice Bonnie Warkentin in Courtroom 205 today, Friday January 31,2020 is 34 year old CHARLES NORMAN CASMEY.
CASMEY is facing charges of second degree murder in the death of Joseph Harry Pruys Sr.
The dynamic Crown Attorney duo of Gordon Fillmore and Derrick Silvestro are present along with Toronto defence attorney Nicole Rozier.
CASMEY PLEADS NOT GUILTY TO SECOND DEGREE MURDER.
HE PLEADS GETS TO THE LESSER OFFENCE OF MANSLAUGHTER AND PLEADS GUILTY TO ASSAULTY CAUSING BODILY HARM TO HIS GIRLFRIEND AS WELL AS BREACH OF BAIL.
Court documents say that on the evening of February 25,2018, Charles Casmey was at home when his girlfriend went out drinking to several bars around the city. She returned to 506 McLaughlin Street where she lived CASMEY, his mother and stepfather Joseph Harry Pruys Sr.
She and Casmey began consuming large amounts of alcohol and cocaine in the basement suite. An argument ensued where CASMEY assaulted her to the head knocking her out unconscious. When she came to, she went to the upstairs bedroom to get Joseph Pruys to phone police.
An enraged CASMEY also went upstairs with a knife. He confronted PRUYS and began stabbing him. A total of 14 stab wounds. There were 2 stab wounds in chest area, 5 in the upper chest, 3 in the neck, 2 in the left arm and 2 in the back.
CASMEY then fled the residence in his girlfriend’s Chevy Cruz. She called 911. Hardworking TBPS Officers arrived at 5:40 am to find Joseph Pruys dead. Paramedics arrived to tend to Hi girlfriends swollen jaw.
CHARLES CASMEY NOW WANTED FOR MURDER AND ON THE RUN. HE WAS IN POLICE CUSTODY ON FEBRUARY 14,2018. CASMEY WAS RELEASED ON BAIL BY JUSTICE OF THE PEACE DENETTE MASLACH THAT DAY ON 5000$ NO DEPOSIT BAIL.
CASMEY WAS RELEASED ON BAIL TO HIS MOTHER AND SUPPOSED TO BE ON 24/7 HOUSE ARREST FOR AN ALLEGED INCIDENT ON FEBRUARY 5,2018
It would be several hours later before the Director of Communications at TBPS would notify the public. Even a killer on the loose barely motivates the Director. The former ad salesman for TBLAZYWATCH just doesn’t work as hard as our front line officers.
CASMEY ARRESTED AFTER 2 HOUR STANDOFF WITH POLICE
On March 1, 1018 CHARLES CASMEY surrendered to police at 9:25 p.m. He had barricaded himself in a residence on the 500 block of McTavish Street after police became aware of his whereabouts. Hardworking Thunder Bay Police Service and the Ontario Provincial Police had the place surrounded.
Residents in the immediate vicinity were evacuated from their homes during the standoff.

2006- 2 counts of possession of narcotics.
2008-fail to comply with recognizance, dangerous driving, assault
2009-Dangerous operation of a motor vehicle causing bodily harm.
FEBRUARY 5,2018 INCIDENT
Two males were arrested in response to a disturbance call on the evening of February 5, 2018 on Tuscany Drive.
Patrol officers arrived at the residence just after 8:30 p.m. and located five males involved in an altercation in the garage. While police were attempting to determine what was going on, three males got into a vehicle, backed into a police cruiser and fled the scene. An ambulance was called to attend to the 24 year old and 25 year old males victims who required minor medical attention.
It was reported that the three suspects approached the victims outside the residence and ordered them into the garage, items were taken from them and an assault began. The involved parties are known to each other. Investigators were able to identify the driver of the vehicle that fled and put him out for location.
Despite fleeing that crime scene, ramming a police car and being wanted, the Director of Communications at TBPS didn’t even bother warning the public about CASMEY on the loose.
On February 6, 2018 at 11:50 a.m. the driver, CHARLES CASMEY was located by patrol officers in the Ogden Street area. An attempt to stop the vehicle was unsuccessful. Officers located the vehicle a short time later in the area of Southern Avenue and May Street. The driver exited the vehicle and was taken in to custody in the Wiley Street area after a short foot pursuit.
Charles Norman Casmey, was charged with Robbery x 2, Forcible Confinement x2, Flight from Police, Dangerous Driving, Drive Disqualified and Failure to Stop at the Scene of an Accident.
HE RECEIVED A TOTAL 14 MONTHS SENTENCE FOR THAT INCIDENT
Just before 7:30 p.m. on February 6, 2018, Carson Eade, 29 years old, turned himself in at the Balmoral Police Station for the Tuscany Street incident. He was taken into custody and charged with Robbery x2 and Forcible Confinement x2.
CHARLES CASMEY WAS RELEASED ON BAIL ON FEBRUARY 14,2018 by Justice of the Peace Denette Maslach and promptly started violating his bail conditions. It would be less than 2 weeks before Joseph Pruys would be dead at the hands of CASMEY.
This prompted outrage from the family of the victims
A letter was sent to the Attorney General of Ontario from the Canadian Resource Centre For Victims of Crime regarding Ontario’s Bail Policy.
SENTENCING SUBMISSIONS FOR 11-14 YEARS.
DEFENCE SUBMISSION IS FOR 11 YEARS
CASMEY had originally retained the services of high caliber lawyer MICHAEL MOON out of Toronto. MOON’S partner, Nicole Rozier is here to address the court for this plea agreement. She has been active on this case along with Moon.
The court hears that there was originally 2-3 weeks of pretrial motions scheduled for May 2020 and a 6-8 week jury trial scheduled starting September 2020.
She submits to Her Honour that CASMEY has taken responsibility for his crimes and thus not wasted the court’s time.
She submits case law to the court that she believes is relavent, highlighting the similarities and differences. Rozier begins to speak about numerous details of the the case law. But Her Honour Warkentin interrupts to advise Ms Rozier that she has already read the case law and therefore doesn’t need to hear all the details. She advises Rozier that she can just summarize her position on sentencing as it relates to the case law.
Rozier feels that 11 years is enough time for this manslaughter conviction. She says that Casmey will have to serve time in a federal penitentiary and this is a harsh punishment. She conveniently leaves out the fact that he will only a serve a maximum of 2/3 of the the sentence behind bars.
She submits that 3-4 months concurrent is plenty for his breach of bail and 12 months concurrent for the assault causing bodily harm.

He addresses the aggravating factors in CASMEY’S crimes.
Charles Casmey attacked and killed a much older victim in his own home. Also the domestic assault is aggravating. He did this all while on bail and violating court orders to keep the peace and be of good behaviour as well as being required to abstain from drugs and alcohol. also fleeing the scene when required to remain indoors at all times while on bail.
Crown Attorney Fillmore addresses Casmey’s criminal record. It is not insignificant. Crimes of violence, failure to follow court orders and crimes that endanger the public
VICTIM IMPACT STATEMENTS.
A statement prepared by the Brandy Oldale, the daughter of Joseph Pruys is read by the Crown Attorney Silvestro. She laments the loss of her father to her, her children and the whole family. She describes the physical effects of sleepless night and the emotional pain that CASMEY has placed on her. Her statement says that CASMEY will forever be known as a murderer. She also hopes that everytime the cell door shuts that CASMEY remembers the victim.
Next statement is from Joseph Pruys Jr, also read by Crown Attorney Silvestro. The 34 year old Bombardier worker states that he took 5 months off work because of this and the emotional toll it took on him. He describes the stress of the loss of his father and the loss of the grandfather for his daughter. His father will not be able to attend his wedding. He will never forgive CHARLES CASMEY.
Herman Pruys, the brother of Joseph reads a statement on behalf of the entire Pruys family including members from Fort Frances and Chilliwack BC. He describes the emotional pain to the entire family knowing how violently he was killed and the hardships caused having to deal with this. The family hopes that CASMEY’S two boys grow up to be fine young men so that something good can They wish CASMEY a lengthy prison sentence. Several family members are emotional in court during his statement.
Her Honour Warkentin gives opportunity to CASMEY to address the court. CASMEY smiles at his lawyer Nicole Rozier and she states that she will address the court on behalf of CASMEY.
She tells the court that CASMEY feels there are no words he can say that will address his behaviour. He acknowledges the impact of his actions on the family of Pruys. But she states he realizes the impact of his actions on himself and his own children.
CASMEY HAS BEEN IN CUSTODY AT THE THUNDER BAY JAIL SINCE MARCH 1, 2018.
CASMEY will only receive enhanced credit from December 1,2018 due to the fact that March to December jail time was attributed to a sentence from the February 5,2018 incident.
That’s a total of 14 months enhanced to 21 months.
JUSTICE WARKENTIN SENTENCES CHARLES CASMEY TO A GLOBAL SENTENCE OF 12.5 YEARS
Her Honour addresses the family and friends in the court regarding the law and this case. She discusses her role to impose a fit sentence based on the joint recommendation. She acknowledges this is a crime of extraordinary violence. Joseph Pruys did not deserve this act of violence. There is nothing the court can do to bring back Joseph Pruys. The court can only acknowledge an innocent man was violently killed. She states that 14 years is too high and 12 years is too low.
CASMEY gets 12.5 years for manslaughter. 18 months concurrent for assault bodily harm and 6 months concurrent for breach of bail.
With enhanced jail credit it is reduced to 10.8 years.
In reality, CHARLES CASMEY will receive statutory release in about 7 years.
He receives a weapons ban for life. His DNA is ordered and a no contact order for 12. 5 years with Ryan McKay.
CASMEY SHOWS NO EMOTION AS HE IS BEING SENTENCED, BUT SMILES AND SMIRKS AS HE IS LED OUT OF COURT.
